General Terms and Conditions of Business
1. Scope
The following General Terms and Conditions of Business exclusively apply to each and every transaction concluded or entered in our online shop as well as for standard purchase methods between Messrs Aero Spezial and customers that are deemed consumers under clause 13 German Civil Code (Buergerliches Gesetzbuch – BGB).
2. Conclusion of contract
The contract comes into being by the acceptance of the order by Messrs Aero Spezial. The customer refrains from the receipt of a acceptance declaration according to clause 151 (1) German Civil Code (BGB).
The notification of the customer about the conclusion of the contract is carried out by Messrs Aero Spezial by either an order confirmation or at delivery at latest. When ordering via the Aero Spezial webshop, the order confirmation is carried out by e-mail immediately.
3. Right of revocation
The customer is entitled to revoke the contract in written form without indication of reasons within two weeks by letter, telefax or e-mail or by returning the goods. The two-week revocation deadline begins upon customers receipt of this notification in written form, but not earlier than receipt of goods at the customer, and also not prior to fulfilling our information obligations according to clause 312 c (2) German Civil Code (BGB) in conjunction with clause 1 (1,2) and (4) German Civil Code (BGB-InfoV). To meet the revocation deadline, timely mailing of the written revocation or the return shipment shall suffice. The revocation or return shipment has to be addressed as follows:

The right of revocation does not apply for
- goods, which do not belong to the standard scope of delivery of Messrs Aero Spezial webshop and the printed catalogue and which are being provided upon special customers orders only,
- Data carriers and software like CDs and DVDs
Consequences of revocation
In case of an effective revocation, mutually received goods and services have to be returned. If applicable, Messrs Aero Spezial has to return any drawn uses (i.e. interests). Should the customer not be able to return the goods as a whole or partially only in a deteriorated state, Messrs Aero Spezial potentially must be paid for restitution of lost value. This does not apply in case deterioration of goods has arisen from simply inspecting the goods the way normally done at a retail shop. If the customer use the goods according to its determination she or he will not held responsible of any refund upon deterioration.
The customer has to bear the return shipment postage if and when the delivered goods match the goods he or she has ordered and if the value of the return shipment is less than 40.00 EUR. Return shipment postage for the value of the return shipment over 40.00 EUR, Messrs Aero Spezial has to bear the return shipment postage, whereby the customer bears this postage in advance. The customer will be refunded for his expenses by return. Not properly postpaid return shipments will be rejected.

4. Conditional availability
Messrs Aero Spezial has the right of cancellation of an order for items which are no longer available or which can not be shipped due to legal or other reasons. Already received payments for such an order will be refunded by return of the cancellation of an order.
5. Prices / Surcharge
All prices stated in the Aero Spezial online shop are retail prices in EUR including currently applicable VAT. Additional prices arise for postage and packing (see below) as well as for paying by PayPal and Credit Card (4 % bank charges added to the invoice total for payment by PayPal and Credit Card).
For orders of a value of up to 10.00 EUR, we ask 2.00 EUR surcharge. If surcharge applies, it is listed in the order summary. Messrs Aero Spezial has the right to alter prices according to VAT and price increase from manufacturers/suppliers without separate notice. Specific costs such as import tax for foreign countries have to be borne by the customer.

7. Orders
Each and every order is based on these GTC in its valid version. Orders can be placed by letter, fax or e-mail. There is no minimum order.
Shipping is carried out by DHL Deutsche Post only.
8. Terms of payment
Payment has to be carried out in advance without allowance by the following options:
- Sofortüberweisung (presently for Austria, Belgium, Netherlands, Switzerland and United Kingdom only)
- EU Standard bank transfer (for EU countries and payment in Euro only)
- PayPal (in this case 4 % handling charge will be added to the invoice total)
- Credit cards: AMEX, Diners Club, Mastercard, VISA (in this case 4 % handling charge will be added to the invoice total)
When paying by bank transfer, all fees have to be borne by the customer. The customer has to ensure that the total amount of the invoice without allowance will be credited to the account of Messrs Aero Spezial.
Messrs Aero Spezial can not be made responsible for the loss of money which is transferred by letter post or other kind of dispatch.
9. Place of fulfilment
Place of fulfilment for shipments and payments is Bielefeld.
10. Warranty
The customer has to report Messrs Aero Spezial about any faulty or defective items in written form within 7 days after receipt of the supply.
The warranty is limited to replacement or remedy, opted by Messrs Aero Spezial only.
11. Retention of title
All goods delivered will remain property of our company until full payment is made.
12. Applicable law
For all privities of contract German law applies.
13. Data protection statement
We are pleased with your visit of our website. In spite of attentive examination as regards of contents of external links, Aero Spezial is not responsible for the privacy practices or the content of those websites.
Protecting the security and privacy of your personal data is important to Aero Spezial. Therefore, we conduct our business in compliance with applicable laws on data privacy protection and data security. 13a. Collection of personal information
Every access to our website and every call of a file related to our website is logged. Filing is limited to internal system related and statistic purposes. Logged are: name of called file, date and time of call, transmitted data volume, report about successful call, web browser and inquiring domain.
Additionally the IP addresses of the inquiring computers are logged.
Any further personal data is being collected only, if you provide that data in scope of an inquiry, registration, order or quiz participation.
13b. Use and sharing of personal data
As far as you have provided us with personal data, it will be used for answering your inquiries, processing your orders and for technical administration only.
Sharing of your personal data with third parties is limited to the purpose of order processing, especially transmission of ordering data to suppliers, or for invoice purposes, or if you have agreed to before. You have the right, to revoke a given consent for the future at any time.
Liquidation of saved personal data is carried out, when you revoke the consent of filing, when the saved data is no longer necessary for specific purposes or when the filing is illegal due to other legal regulations.
13c. Right of access
You have the right of free of charge inquiry, revision, barring and liquidation of your personal data at Aero Spezial or in their systems anytime.

13e. Usage rights of data of AERO SPEZIAL:
Use of published contact data like postal addresses, telephone and fax numbers as well as e-mail addresses of the imprint or equivalent data for transmission of not expressly enquired information by third parties is not permitted. By violation of this ban, AERO SPEZIAL expressly reserves the right to take legal measures against these senders.
14. Miscellaneous
Prices, errors and feasibility of supply are subject to change.
According to § 86 Strafgesetzbuch (penal code) decal sheets for models of German Luftwaffe aircraft WW II do not contain swastikas.
